GameStop has agreed to a $4.5 million class action settlement to resolve allegations that it unlawfully shared its customers’ personal data with Facebook through a tracking tool embedded in its website. The lawsuit claims this practice violated the Video Privacy Protection Act (VPPA)—a federal law that prohibits the disclosure of information that identifies a person’s video content purchases without their consent.
The complaint centers around GameStop’s use of the Facebook Pixel, a tool that tracks user activity for advertising purposes. According to the lawsuit, when a customer with a public Facebook account purchased a video game from GameStop.com, details about the transaction—including the exact title of the game—were transmitted to Facebook without their knowledge. This kind of data sharing allegedly enabled Facebook to link users' identities to the specific games they bought, creating a privacy risk.
The lawsuit further argues that consumers had no way to opt out of this tracking or to prevent their personal purchase history from being transmitted to third parties. Plaintiffs say GameStop failed to disclose this data-sharing arrangement and did not obtain proper consent.
GameStop denies any wrongdoing and has not admitted liability. However, the company agreed to settle the case and pay $4.5 million to avoid further litigation.
Eligible customers can choose one of the following benefits:
Cash Payment: Up to $5
GameStop Voucher: Up to $10 to be used toward purchases
Only one form of compensation may be selected per claimant. The final amount each person receives may be adjusted based on the total number of claims submitted.
No proof of purchase is required to file a claim. However, eligible class members must have had a public Facebook profile under their real name and must have purchased a video game from GameStop’s website during the class period.
In addition to monetary compensation, GameStop has agreed to suspend the use of the Facebook Pixel on its website. This change is intended to prevent further data from being shared without transparency and aligns with growing public concern over online privacy and consumer rights.
