Coastal Orthopedics & Sports Medicine has agreed to a $1.4 million class action settlement to resolve allegations it failed to protect sensitive patient information during a data breach that occurred in June 2023. The breach allegedly exposed private data, including Social Security numbers, due to what plaintiffs claim were inadequate cybersecurity safeguards.
The orthopedic provider, based in Florida, offers a range of services such as joint replacement surgery, sports injury treatment, and physical therapy. Following the breach, affected patients were notified that their information may have been accessed or stolen by unauthorized actors.
Plaintiffs in the lawsuit allege that Coastal Orthopedics could have prevented the breach with stronger data security practices. Although the company denies wrongdoing, it has agreed to the $1.4 million settlement to avoid further litigation.
Eligible class members may receive several forms of compensation:
Documented Loss Reimbursement: Up to $10,000 for costs related to the breach, including credit monitoring expenses, bank or credit card fees, fraudulent charges, or related out-of-pocket losses.
Credit Monitoring: Two years of one-bureau credit monitoring, medical information surveillance, and up to $1 million in identity theft insurance.
Cash Payment: A pro rata cash payment from the settlement fund. Individuals whose Social Security numbers were compromised may receive three times the base payout.
Exact cash amounts will depend on the number of valid claims submitted. Those seeking reimbursement must provide documentation of their losses. Class members do not need to submit proof to receive the basic credit monitoring and pro rata cash payment, though enhanced compensation may require verification of specific data exposure.
